From March 21, handling the mobile phone while driving, not wearing a seat belt, overtaking cyclists without respecting the minimum side separation or throwing objects or butts on the road that could cause an accident or fire will be more penalized.
On December 3, the Congress of Deputies approved the Law on Traffic, Motor Vehicle Traffic and Road Safety, which aims to update and improve the effectiveness of the point permit system and strengthen road safety in the roads. The law enters into force on March 21, 2022, three months after its publication in the BOE.
New measures:
Using a phone
Increases the subtraction of points to 6 (before 3) to use the phone, holding it by hand, while driving. The traffic fine remains at €200.
The same penalty and the deduction of 3 points in this case for using the mobile phone, keeping it tight between the helmet and the user’s head while driving.
Wearing the safety belt
To avoid wearing the safety belt, or to wear it incorrectly, as well as child restraint systems, helmet and other mandatory protection equipment, will deduct 4 points (before -3).
Drivers of personal mobility vehicles will be obliged to use the helmet in the terms determined by the regulations. The traffic fine remains at €200.
Cyclists
Increase by 4 to 6 points for all drivers of overtaking vehicles that endanger cyclists without leaving the mandatory minimum clearance of 1.5 meters; the traffic fine will remain at €200.
In addition, on roads with more than one lane in each direction, it will be mandatory to change lanes to pass cyclists and mopeds.
Throw objects and substances
To throw waste or cigarette butts on the road that could result in accidents or fires, deduct –6 points (before -4).
Overtaking/passing
Eliminates the possibility that cars and motorcycles may exceed the speed limits on conventional roads by 20 km / h when overtaking other vehicles.
Minors and alcohol
Minor drivers of any vehicle (mopeds, motorcycles up to 125 cc, bicycles, personal mobility vehicles, etc.) will not be allowed to drive with more than zero alcohol.
Point Recovery
The recovery period for the total number of driving licence points was unified for serious and very serious offences. If two years have elapsed without a firm administrative sanction for the commission of points involving the loss of points, the holders of permits or licenses affected by the partial loss of points will recover the full initial credit of 12 points.
Safe and efficient driving courses
2 points can be recovered from the licence for safe-conducting safe and efficient driving courses.
Cheating in the exam
It will be considered an offense, with a penalty of €500, to use intercommunication devices not authorized in the tests for obtaining or recovering driving licenses or licenses. In addition, the applicant will not be able to re-appear in the tests within six months.
