GOLDEN VISA
DESCRIPTION

The Golden Visa or Investor Visa is a plan that allows citizens outside the EU to obtain qualified residence permits in exchange for investing in Spanish real estate (and other assets), leading to permanent residence in Spain if certain conditions are met:

Application for Community Family Card
DESCRIPTION​

The persons entitled to apply for Community Family Card are the relatives of a Spanish citizen or of another member country of the European Union (EU) or of another country signatory to the Agreement on the European Economic Area (EEA) or Switzerland.

The Member States which are members of the European Union and the States party to the Agreement on the European Economic Area are Austria, Belgium, Bulgaria, Cyprus, Germany, Croatia, Denmark, Slovakia, Slovenia, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Romania, Sweden and Iceland, Norway and Liechtenstein, since the latter three signed this agreement, although they do not belong to the European Union. The EU citizen or other EEA member country must:

  • Being employed in Spain;
  • Being self-employed in Spain;
  • Have sufficient economic solvency to support the family unit during its period of residence.
CIVIL PARTNERSHIP

DESCRIPTION​

Civil Partnership is a legal relationship between two persons, similar to the conjugal one, materialized in a register for record and validity before the law.

  • First of all, the application process is very quick and simple (especially in comparison with the marriage process).
  • Registering as Civil Partnership with a European will allow you to get a residence in Spain.
  • Once you have residence, this procedure will also allow you to obtain nationality.
  • As long as you have been with your partner in Spain for a minimum of 3 years, of which 1 has been of coexistence, you can break your union in fact and continue to have the residence in the country.

The requirements for the constitution will vary depending on the autonomous community or region in which you are located. However, some of them occur in a general way throughout the Spanish territory. These main requirements are:

  1. The citizen of the European Union member of the couple must be resident in that territory
  2. The two members of the couple are required to be registered in the same address
  3. Depending on the region in question, a minimum period of co-existence may be required
  4. The couple must in fact be registered, by public writing, before the notary
  5. Both members must be of age or emancipated
  6. Both members cannot be married

DESCRIPTION​

It is an authorization of residence and work for self-employment or temporary residence authorization that may be obtained by an alien who has ceased to hold a residence card of a relative of a citizen of the Union for invalidity of the marriage bond, divorce or cancellation of registration as a registered partner.

Provided that the marriage or registered couple’s status has lasted for at least three years, until the commencement of legal proceedings for annulment, divorce or cancellation of registration.

The non-lucrative residence residency is one of the different types of Spanish visas granted to non-EU citizens who have enough financial capacities to stay in the country without working. As that is also true for the applicant’s relatives, as you can also bring your family with you.

The family reunification visa
DESCRIPTION

Family reunification is the procedure for foreigners by which a Non-European citizen with a residence permit in Spain can bring his or her family into the country, granting them a residence and work permit.

It is important to note that only foreigners resident in Spain who have renewed their initial residence permit can realize this process.

If you have stayed in Spain for less than a year legally, you still cannot regroup your relatives. You must have a renewed residence permit.

In addition, as a general rule, in order to regroup a family member you must be able to prove that the person is financially dependent on you.

For spouse/child reunification, you must have a renewed residence for 2 years. In case of parents must be 5 years old (long term card)

The “arraigo social” is a procedure for regularizing the documentary situation in Spain that gives access to a residence and initial work authorization, lasting 1 year. It is the option most used by migrants who want to get a residence stay permit  in Spain. It is based on the existence of strong and important links with the community in which it resides.

DESCRIPTION

ARRAIGO LАBORAL is a temporary residence permit for exceptional circumstances that may be granted to foreign citizens who are in Spain for 2 years and have had employment relations for a minimum of six months.

IN THE CASE IF:

– Have been denied asylum

– Lost stay permit in Spain

– Does not satisfy the criteria of ARRAIGO LАBORAL

You must prove that you have worked for a minimum of 6 months, with or without a work contract.

THE REQUIREMENTS:

  1. Have resided in Spain for the last 2 years.
  2. Have worked for a minimum of 6 months.
  3. Inform no criminal record in Spain

If you have worked legally and lost your permission, it will be enough to present your work life to prove it. If you have worked without a contract, you will need a court ruling or a job inspection report to prove it.

DESCRIPTION

Foreigners wishing to carry out research, training (non-salaried) or undertake studies at an educational center (public or private), officially recognized in Spain, must apply for this type of visa.

DESCRIPTION

It is an annual extension of the authorization to carry out studies, exchange of students, non-labor practices or voluntary services in Spain. The annual extension of the stay of the relatives of foreigners in a situation of stay for studies, exchange of students, is also authorized. Non-work practices or volunteer services.

DESCRIPTION

This is a temporary residence and work permit that an employer requests to hire an employee in Spain after doing study (employment contract granted).

After having stayed in Spain on the basis of a student card for 3 years or more, it is possible to apply for a modification of the study stay to the employment contract. Applications for modification a made 90 days before the student’s three-year term of stay on the card.

Requirement:

  • Legal residence in Spain as a student for the last 3 years and successful completion of studies
  • No criminal record of a student in Spain and in all countries in which he previously resided (residence/citizenship)
  • The existence of an employer who will award an employment contract (company, individual entrepreneur or individual)

Modification of the visa is possible if the student has not received any scholarships or subsidies from private or public organizations in Spain or in his country of origin.

For an employer, the employer is required to:

  • To be registered in the register of the social insurance system;
  • To be free of tax and social security arrears;
  • To have the economical means to fulfil the obligations of the contract and to cover the expenses of the business itself;
  • Grant a contract (indefinido 40 hours) signed by both parties guaranteeing continuous employment for the entire duration of the residence (1 year followed by an extension)

DESCRIPTION

This authorization may be requested by foreigners who have held a prior authorization for a study stay and who have completed their studies at an approved higher education institution in Spain, reaching at least Level 6 according to the European Qualifications Framework, corresponding to university degree accreditation (This heading covers “la enseñanza universitaria, las enseñanzas artísticas superiores, la formación profesional de grado superior, las enseñanzas profesionales de artes plásticas y diseño de grado superior, y las enseñanzas deportivas de grado superior”).

WORK PERMIT FOR STUDENTS
DESCRIPTION​

The status of the foreign student in Spain is a stay, so with this authorization you will not be allowed to work unless you apply in parallel for a work authorization (known as “Work authorization for foreign account for holders with a study stay card”).

Work Authorization for Students must be requested during the term of the Student Stay Authorization and will be the same as the Student TIE.

REUNIFICATION OF MEMBERS OF FAMILIES WITH STUDENTS
DESCRIPTION​

Relatives of foreigners who have applied for a study visa or are in Spain as holders of a stay authorization by Studies may apply for a stay visa to enter and remain legally in Spain during the term of their stay in the same situation as the student. Obtain the NIE-number for professional or social reasons, an interested person may contact:

  • The Spanish migration authorities in the place of residence. A mandatory requirement to obtain a NIE-number is the legal presence of a foreign citizen in Spain.

Consulate of Spain in the country of residence of a foreign citizen.

Please note that Spanish legislation establishes a different procedure for obtaining the NIE-number for Europeans and for citizens of countries outside the European Union. The procedure and deadlines may also differ for citizens of the EU and other non-European countries.

If you plan to buy a property or a vehicle in Spain, open a bank account or open company, you will first need to obtain a Foreigner Identification Number (NIE).

This number, which is also a Tax Identification Number (NIF), will allow you to register as a taxpayer and fulfill in the future your obligations to tax on Non-Resident Income Tax, Real Estate, Vehicles, etc.
